Terms and Conditions

1 Interpretation

“Agreement” means together these Conditions of Hire together with related booking form

“Countrypad LLP” means Countrypad LLP as registered at Companies House under Registered Number OC327381 and
whose registered office is Felin Newydd House Llandefalle Brecon Powys LD3 0NE). “Booking Fee” means being 30% of the full charge or full cost

“The Hirer” means the company or individual holding a function at the Property. The Hirer is contractually bound by the clauses contained in these Conditions of Hire.

“The Property” means the areas designated for hire of either of the following as applicable (i) Felin Newydd House Llandefalle Brecon Powys LD3 0NE or (ii) Blaencwm Lord Hereford’s Knob Three Cocks Brecon LD30SR

2 Bookings Confirmation & Payment

2.1 Provisional reservations will be held for a maximum of 48 hours from the initial contact
2.2 Booking online: the booking becomes binding upon payment of the Booking Fee being received by Countrypad LLP in cleared funds from the Hirer. Payment of the Booking Fee shall be deemed to be confirmation of acceptance of the terms and conditions of the Agreement
2.3 Booking in any other manner than online: upon confirmation of a request to make a booking Countrypad LLP will issue the Hirer with (i) a booking form and (ii) an invoice for the Booking Fee. The booking form must be signed and returned along with the Booking Fee payment in cleared funds within 7 days of the date of the Booking Fee invoice. The Booking Fee is non- refundable and non-transferable. The booking form becomes binding when it is returned signed to Countrypad LLP and it is then accepted by Countrypad LLP (although this acceptance need not be in writing).
2.4 An invoice for the remaining 70% of the full charge will be issued 6 weeks prior to the event (or immediately with the deposit invoice if less than 6 weeks) and must be paid within 7 days of the invoice date and in any event in cleared funds before the event takes place.
2.5 l Invoices not paid within the specified timeframes will incur interest at 4% over the Barclays Bank base rate per annum for the periods following the due date.
2.6 Wedding events and hire cannot be made by online booking.

3 Cancellation

3.1 By the Hirer
In the event that the Hirer for whatever reason cancels a confirmed booking a cancellation charge of 30% of the venue or hire fee shall be made. If the cancellation is within 6 weeks of the event the full hire fee is payable.
3.2 By Countrypad LLP
3.2.1 Countrypad LLP reserves the right to cancel an online booking within 7 days of the booking being made. In such event the full Booking Fee shall be refunded to the Hirer.
3.2.2 Countrypad LLP reserves the right to cancel any booking by the Hirer by written notice (in accordance with Clause 12) on not less than 90 days prior notice. In the event of Countrypad LLP exercising this right to cancel, Countrypad LLP will refund all sums paid to it by the Hirer for the applicable booking within 14 days of the date of the notice without further liability to the Hirer whatsoever. Any late payment of the refund will incur interest at 4% over the Barclays Bank base rate per annum for the periods following the due date.

4 Use of Property

The Hirer agrees and undertakes as follows:
4.1 Not to use the Property other than for the purpose of the function as specified in the booking form and in such manner as Countrypad LLP acting reasonably may direct from time to time.
4.2 To pay Value Added Tax at the appropriate rate chargeable on the hiring charge and on any other supply of services or goods under the hire agreement.
4.3 To ensure that good order of staff and guests is kept whilst on the Property and at time of exit and to ensure that no activity is carried out that shall cause nuisance or annoyance or is not inconsistent with the authorized use.
4.4 To take all reasonable care of the Property and contents therein and to indemnify Countrypad LLP for the cost of making good all damage and loss or theft caused to the Property and any contents therein (including the replacement cost if Countrypad LLP reasonably believes is appropriate).
4.5 To ensure that items brought onto the Property during the period of hire is removed from the Property on expiration of the period of hire so that the Property is vacated and left in a clean and orderly state. Countrypad LLP shall be responsible for the removal of bagged domestic kitchen refuse and recyclable waste at the end of the event if it is left in a tidy and appropriate manner in the appropriate designated area in the Property. Any items left in the Property after the event shall be dealt with as Countrypad LLP acting reasonably sees fit.
4.6 Not to permit any activity which may render an increased premium payable for insurance of the Property or any part thereof or to carry out any activity this may void any such policy of insurance.
4.7 not to leave children unattended outside
4.8 not to fire a gun or let off a firework without the prior consent of Countrypad LLP
4.8 To indemnify Countrypad LLP against all costs, expenses, actions, claims, demands and liability arising from any non- compliance with the terms and obligations of this Agreement.

5. Terms that relate exclusively to Felin Newydd House

5.1 The Hirer agrees and undertakes as follows:

5.1.1 Provide all contractors names, addresses and telephone numbers at the time of the confirmation of the
booking of Felin Newydd (or such later time by agreement with Countrypad LLP) and shall indemnify Countrypad LLP against any loss, damage, claim or expense in respect of all sub-contractors engaged by the Hirer to carry out work solely in connection with the said event.
5.1.2 Not to allow more than 18 people to stay in Felin Newydd overnight

5.2 Equipment brought into the premises

5.2.1 Countrypad LLP must approve all contractors engaged by the Hirer of Felin Newydd before the Hirer
formally agrees to hire them. The contractors are responsible for evidencing documentation appertaining to applicable legislation including copies of risk assessment documentation appertaining
to the event. The contractors are required by law to supply staff trained and are fit for the purpose, for
which they are employed.
5.2.2 Permission must be obtained from Countrypad LLP for the construction of display units, audiovisual
equipment, etc at Felin Newydd. Restrictions relate to weight of individual items, dimensions and
proposed position with regard to the safeguarding of Felin Newydd and its contents.
5.2.3 Countrypad LLP shall not be responsible for goods, equipment, personal effects left at Felin Newydd
before during or after any function. Such items may be left at the Hirer's risk and only by arrangement with Countrypad LLP.

5.3 Music and Entertainment

Music, Entertainment and Dancing are allowed at Felin Newydd at the discretion of Countrypad LLP by prior written arrangement

5.4 Catering and Cellar

5.4.1 Countrypad LLP has a list of approved caterers that are allowed to bring food and drink to Felin
Newydd. The Hirer must obtain Countrypad LLP’s prior consent to use any other caterers and reserves
the right to refuse to consent if it believes that it has reasonable cause.
5.4.2 Countrypad LLP disclaims responsibility for all matters connected with catering and entertainment and
the Hirer will enter into a direct contract with the caterers.
5.4.3 If Countrypad LLP gives the Hirer a key to the cellar at Felin Newydd where consumables are housed.
If any are consumed, the Hirer agrees to pay for them at the cost as set out on the price list in the cellar. The Hirer shall return the key to Countrypad LLP at the end of the Hire.

5.5 Felin Newydd House Equipment

A piano, in the Drawing Room of Felin Newydd, is available for use free of charge by arrangement with Countrypad LLP. No other pianos may be brought onto the property without permission of Countrypad LLP.

5.6 Unacceptable Conduct

Countrypad LLP reserves the right to:
5.6.1 Refuse entry to Felin Newydd to any persons conducting themselves in an unseemly manner (to be decided in Countrypad LLP’s absolute discretion).
5.6.2 Close any function, at which the Hirer either contravenes the above conditions, departs from the previously agreed programme or permits guests to conduct themselves in an unseemly manner (to be decided in Countrypad LLP’s absolute discretion).

5.7 Dogs

A maximum of two dogs can be housed in the back hall of Felin Newydd with the Hirer’s own bedding. Dogs are not allowed into any of the other parts of the house. If there is a breach of this term the Hirer agrees to pay the cleaning charges for all applicable areas of the house.

5.8 Outdoor Footwear

Outdoor footwear is not permitted upstairs in Felin Newydd. The Hirer agrees to pay for the cleaning, repairing and replacing of the carpets caused by breach of this restriction.

6. Terms that relate exclusively to Blaencwm

6.1 Dogs

A maximum of two dogs are allowed inside Blaencwm provided that they remain in the uncarpeted parts at all times. If there is a breach of this term the Hirer agrees to pay the cleaning charges for all applicable areas of the house.

6.2 Occupancy

The Hirer agrees not to allow more than 8 people to stay in Blaencwm overnight

7. Smoking

Smoking is not permitted in the Property. 'No Smoking' notices can be displayed if a written request is made to Countrypad LLP by the Hirer.

8. Cancellation/Interruption of Services due to Unforeseen Circumstances (Force Majeure)

Countrypad LLP shall use their reasonable endeavors to provide facilities referred to in this Agreement and any Booking form, but they shall not be liable for any loss or damage or inconvenience whatsoever occasioned by any interruption in or failure to provide any such services or facilities due to causes beyond their control (including without limitation strikes, lock- outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, or failure of public or private telecommunications networks or impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport).

Cancellation Insurance is strongly advised

9. Limitation of Liability

9.1 With the exception of death or personal injury caused by Countrypad LLP’s negligence, Countrypad LLP’s liability shall be limited to the full charge under this Agreement
9.2 Countrypad LLP shall not be liable in contract, tort, negligence, breach of statutory duty or otherwise for any loss, damage, costs or expenses of any nature whatsoever incurred or suffered by the Hirer of an indirect or consequential nature including without limitation any economic loss or other loss of turnover, profits, business or goodwill.
9.3 Each of the parties acknowledges that, in entering into this Agreement, it does not do so in reliance on any representation, warranty or other provision except as expressly provided in this Agreement, and any conditions, warranties or other terms implied by statute or common law are excluded from this Agreement to the fullest extent permitted by law. Nothing in this Agreement excludes liability for fraud.

10. Bond

Countrypad LLP requires a bond of £1000 for Felin Newydd and £300 for Blaencwm to be held for each booking. This bond shall be returned in full pending the result of the full inventory report which shall be completed 24hours from the departure time. The bond may be secured by means of an authorised credit card for the full amount or by money transferred to our bank account.

11. Other

11.1 Any variations to the Agreement shall only be valid if they are signed by both parties (unless otherwise specified in these terms and conditions)
11.2 The Hirer cannot assign, delegate, sub-contract, mortgage, charge or otherwise transfer any or all of its rights and obligations under this Agreement without the prior written agreement of Countrypad LLP.
11.3 This Agreement contains the whole agreement between the parties and supersedes and replaces any prior written or oral agreements, representations or understandings between them. The parties confirm that they have not entered into this Agreement on the basis of any representation that is not expressly incorporated into this Agreement. Nothing in this Agreement excludes liability for fraud.

12. Notices

Any notices to be given under this Agreement shall be given to Countrypad LLP’s registered office only (not by email). in the event of the Hirer wishing to serve Countrypad LLP notice in the event of Countrypad LLP wishing to serve notice to the Hirer then such notice shall be valid if sent to any address given at any time to Countrypad LLP (including email). Notices sent as above shall be deemed to have been received two working days after the day of posting (in the case of inland first class mail), or on the next working day after transmission (in the case of facsimile messages, but only if a transmission report is generated by the sender's facsimile machine recording a message from the recipient's facsimile machine, confirming that the facsimile was sent to the number indicated above and confirming that all pages were successfully transmitted) or immediately in the case of hand delivery or email.

13. Jurisdiction

These terms and conditions and the contract shall be governed by the laws of England and Wales and shall be subject to the exclusive jurisdiction of the English or Welsh Courts.
